These Terms of Use ("Terms") govern your access to and use of the website, products, and services provided by Restore Printer Repair Services ("Restore," "we," "us," or "our"). Please read these Terms carefully before using our services.

By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

PLEASE NOTE: These Terms contain an arbitration provision that requires disputes to be arbitrated on an individual basis. By accepting these Terms, you are waiving your right to participate in class actions.

1. Use of Our Services

1.1 Eligibility

You must be at least 18 years old to use our services. By agreeing to these Terms, you represent and warrant that: (i) you are at least 18 years old; (ii) you have not previously been suspended or removed from our services; and (iii) your use of our services does not violate any applicable laws or regulations.

1.2 Account Registration

To access certain features of our services, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

1.3 Prohibited Uses

You agree not to use our services for any purpose that is unlawful or prohibited by these Terms. Prohibited uses include, but are not limited to:

  • Using our services in any manner that could disable, overburden, damage, or impair our services;
  • Using any robot, spider, or other automatic device, process, or means to access our services for any purpose;
  • Introducing any viruses, Trojan horses, worms, logic bombs, or other harmful material;
  • Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of our services;
  • Using our services to send, knowingly receive, upload, download, use, or re-use any material that violates third-party rights;
  • Impersonating or attempting to impersonate Restore, a Restore employee, another user, or any other person;
  • Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of our services.

2. Printer Repair Services

2.1 Service Appointments

When scheduling a printer repair service, you agree to provide accurate information about your printer issues and ensure access to the printer at the scheduled appointment time. If you need to reschedule or cancel an appointment, please provide at least 24 hours' notice to avoid cancellation fees.

2.2 Service Diagnosis

Our technicians will diagnose your printer issues and provide a cost estimate before proceeding with repairs. You have the right to decline any recommended repairs, but diagnostic fees may still apply as specified in our current fee schedule.

2.3 On-Site Services

For on-site services, you agree to provide a safe working environment for our technicians. You acknowledge that certain repairs may require the printer to be transported to our repair facility if they cannot be completed on-site. In such cases, we will provide estimated timeframes for repair completion.

2.4 Parts and Repairs

We may use new, used, or refurbished parts in the repair of your printer, as long as they meet the manufacturer's specifications. You acknowledge that:

  • We cannot guarantee the availability of all parts for obsolete or discontinued printer models;
  • Some repairs may affect existing warranties from the original manufacturer;
  • We do not guarantee data preservation during the repair process and recommend backing up any important data before service.

2.5 Service Warranties

Our repair services come with limited warranties as specified in your service agreement. These warranties apply only to the specific components repaired and do not cover:

  • Damage resulting from misuse, abuse, or failure to follow manufacturer guidelines;
  • Issues unrelated to the original repair;
  • Damage caused by software, viruses, or network problems;
  • Normal wear and tear;
  • Environmental damage (water, fire, power surges, etc.).

3. Payments and Billing

3.1 Fees and Charges

All fees and charges for our services will be clearly communicated to you before any work begins. Our current fee schedule is available upon request and may be updated from time to time. You agree to pay all fees and charges associated with your use of our services according to the payment terms in effect when the service is rendered.

3.2 Payment Methods

We accept various payment methods, including credit cards, debit cards, and electronic bank transfers. By providing a payment method, you represent that you are authorized to use the payment method and agree that we may charge your payment method for any services you purchase.

3.3 Invoicing and Payment Terms

Invoices are typically presented upon completion of services, and payment is due immediately unless prior arrangements have been made. For business customers with established accounts, our standard payment terms are net 30 days from the invoice date. Late payments may be subject to interest charges at the rate of 1.5% per month or the maximum rate permitted by law, whichever is less.

3.4 Unpaid Balances

If you fail to pay for services rendered, we reserve the right to:

  • Retain possession of your printer until payment is received (mechanic's lien);
  • Charge reasonable storage fees for equipment left in our possession;
  • Report unpaid balances to credit reporting agencies;
  • Refer unpaid accounts to collection agencies or legal counsel.

You agree to reimburse us for all reasonable costs incurred in collecting any unpaid amounts, including but not limited to attorney's fees and court costs.

4. Intellectual Property Rights

4.1 Ownership

The Restore website, including its content, features, and functionality, is owned by Restore Printer Repair Services and protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. These Terms do not grant you any right, title, or interest in our services or content.

4.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our website for your personal, non-commercial use. This license does not include the right to:

  • Modify, reproduce, distribute, or create derivative works based on our website or its content;
  • Use any data mining, robots, or similar data gathering or extraction methods;
  • Download (other than page caching) any portion of our website, except as expressly permitted;
  • Use our website or its content for any commercial purpose.

4.3 Trademarks

The Restore name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Restore Printer Repair Services or its affiliates or licensors. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on our website are the trademarks of their respective owners.

4.4 User Feedback

If you provide us with any feedback, suggestions, improvements, or ideas regarding our services ("Feedback"), you grant us an irrevocable, perpetual, worldwide, royalty-free license to use, disclose, reproduce, license, distribute, and exploit such Feedback without restriction or any obligation to compensate you.

5. User Content

5.1 User-Generated Content

Our services may allow you to post, submit, publish, display, or transmit content such as reviews, comments, or suggestions ("User Content"). By providing User Content, you grant us and our affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

5.2 User Content Representations

You represent and warrant that:

  • You own or control all rights to your User Content or have the right to grant the license above;
  • Your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person;
  • Your User Content does not contain material that is false, intentionally misleading, defamatory, obscene, harassing, or otherwise objectionable.

5.3 Monitoring and Enforcement

We have the right, but not the obligation, to monitor, edit, or remove any User Content. We take no responsibility and assume no liability for any User Content posted by you or any third party. Violating these standards may result in termination of your account or legal action.

6. Disclaimers and Limitations of Liability

6.1 Disclaimer of Warranties

YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. OUR SERVICES AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, RESTORE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE WITH ALL SOFTWARE, SYSTEMS, OR DEVICES, OPERATE WITHOUT INTERRUPTION, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS, BE ERROR-FREE, OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.

6.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL RESTORE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR SERVICES OR CONTENT.

THIS INCLUDES ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

6.3 Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

7. Indemnification

You agree to defend, indemnify, and hold harmless Restore, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms;
  • Your User Content;
  • Your use of our services;
  • Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right.

8. Dispute Resolution and Arbitration

8.1 Informal Dispute Resolution

For any dispute or claim relating to these Terms or our services, you agree to first contact us at solutions@restoreprinter.com and attempt to resolve the dispute informally. If we cannot resolve the dispute informally within 60 days, either party may proceed to formal dispute resolution.

8.2 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or our services that cannot be resolved informally shall be determined by binding arbitration. The arbitration will be conducted by a single arbitrator under the Commercial Arbitration Rules of the American Arbitration Association (AAA) and will take place in Russel Square, UK, or at another mutually agreed location.

8.3 Class Action Waiver

YOU AND RESTORE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and Restore agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

8.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights pending the completion of arbitration.

9. Termination

9.1 Termination by Restore

We reserve the right, at our sole discretion, to terminate or suspend your access to all or part of our services, with or without notice and for any reason, including, without limitation, breach of these Terms.

9.2 Termination by You

You may terminate your account at any time by contacting us at support@restoreprinterrepair.com or by following the instructions on our website. Upon termination, you will remain liable for any outstanding obligations related to your use of our services.

9.3 Effect of Termination

Upon termination of these Terms for any reason:

  • Your right to access and use our services will immediately cease;
  • We may delete or archive any of your User Content;
  • Any provision of these Terms that expressly or by implication is intended to come into or continue in force on or after termination will remain in full force and effect.

10. General Provisions

10.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any choice or conflict of law provision or rule.

10.2 Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of the Terms will continue in full force and effect.

10.3 Waiver

No waiver by Restore of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Restore to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

10.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without Restore's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. Restore may freely assign or transfer these Terms without restriction.

10.5 Entire Agreement

These Terms, our Privacy Policy, and any service agreements or other terms and conditions incorporated herein by reference constitute the sole and entire agreement between you and Restore regarding the services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.

10.6 Amendments

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our services.
